A Forks man will spend 90 days in jail and serve a year of community custody after entering a guilty plea to charges involving the assault and intimidation of a law enforcement officer.
The 32-year-old defendant entered his plea on September 24 in Clallam County Superior Court. He acknowledged guilt to third-degree assault of a law enforcement officer and felony harassment against a criminal justice participant. Both charges are classified as Class C felonies.
Judge Elizabeth Stanley accepted a sentencing recommendation that had the endorsement of both the prosecution and the defense. The sentence was issued under Washington’s first-time offender waiver provisions. The court determined the defendant met the criteria for this waiver, which state law defines as allowing eligible individuals without prior felony convictions or deferred prosecutions to receive up to 90 days of confinement. The statute also permits a sentence of up to one year of community custody when treatment is mandated.
Credit for eligible time served in this matter will be applied, with the jail administration responsible for calculating the specific amount.
In a signed plea statement, the defendant admitted to intentionally striking a police officer while that officer was carrying out official duties. The document also details that the defendant threatened the officer with bodily harm, causing a reasonable fear that the threat would be executed. The offenses are dated to on or about June 5 in the plea agreement and judgment.
As part of the plea bargain, prosecutors agreed not to pursue driving under the influence or other related charges stemming from the same investigation conducted by the Forks Police Department.
During the community custody period, supervised by the Department of Corrections, the defendant must report as directed to a community corrections officer. He is prohibited from possessing or consuming alcohol and is required to obtain an evaluation for substance use disorders while complying with any recommended treatment. The court also classified the defendant as indigent and waived legal financial obligations.
